DMCA Policy

About This Policy

Holmnium, operated by Zerminum, respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy describes the process for reporting alleged copyright infringement and submitting counter-notices.

Important note: Holmnium is an inbound-only email relay. We do not host user-generated content in the traditional sense — we receive and temporarily store email messages sent to our users' disposable addresses. Email content is automatically and permanently purged within 1–24 hours. We have no control over what third-party senders transmit to our users.

We accept DMCA notices by email. Physical mail is accepted but significantly slower to process.

2. Filing a Takedown Notice

To submit a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are at issue.
  2. Identification of the infringing material — Sufficient information to locate the allegedly infringing content on Holmnium (e.g., inbox address, email identifier, or URL if applicable).
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the copyrighted work is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement that the information in the notice is accurate, made under penalty of perjury.
  6. Signature — A physical or electronic signature of the copyright owner or person authorized to act on their behalf.

Knowingly submitting a materially false DMCA notice may expose you to liability for damages under 17 U.S.C. § 512(f), including costs and attorneys' fees.

3. Counter-Notice

If you believe content was removed due to mistake or misidentification, you may file a counter-notice under 17 U.S.C. § 512(g)(3). A valid counter-notice must include:

  1. Your contact information — Your name, mailing address, telephone number, and email address.
  2. Identification of the removed material — A description of the material that was removed and its location before removal.
  3. Good faith statement — A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
  4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the district where you are located (or, if outside the US, any judicial district where Zerminum may be found), and that you will accept service of process from the original complainant.
  5. Signature — Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed content at our discretion.

4. Repeat Infringer Policy

Holmnium will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat copyright infringers. We reserve the right to make this determination at our sole discretion. Terminated accounts are not eligible for a refund.

5. Limitations on Our Responsibility

As an email relay service, Holmnium functions as a passive conduit for third-party communications. We do not proactively monitor the content of emails delivered to our users' inboxes. Copyright infringement in email content is primarily the responsibility of the sender, not Holmnium. All email content is automatically and permanently deleted within 24 hours of creation at most.
